Purpose of the Notice and Demand to Commence Suit
Illinois Statutes Chapter 770 (ILCS 60/34) provides that on written demand from an owner or other person with an interest in the subject property, the contractor, laborer or supplier who filed the original lien has 30 days from receipt of the Notice to enforce its lien by commencing a lawsuit or filing an answer to the demand. Failure to do either within the 30-day period will result in the lien being forfeited.
Restrictions on Use
This form of Notice of Demand is for private projects and cannot be used for public projects.
